Lawsuits

Jacob McCoy, as administrator of the estate of Randy R. McCoy, deceased, filed a complaint July 10 against Area Ambulance Service, Inc., seeking an amount in excess of $50,000 in connection with the July 10, 2017, death of R. McCoy, alleging the ambulance service failed to have working batteries available to power its cardiac monitor; failed to have automatic external defibrillator pads that were compatible with its AED unit; and otherwise acted in a manner that showed indifference to or conscious disregard of R. McCoy.

Wayne Burns filed a complaint in forcible entry and detainer July 2 against Kim Miller, Glen Deffenbaugh and Ashley Kershaw, seeking possession of property in Carlinville, $3,342 rent and court costs.

John M. Lutz filed a complaint in forcible entry and detainer July 3 against Perry Ashby, seeking possession of property in Girard and $4,100 rent.

Jeffrey and Diana Helvey filed a complaint July 3 against Niccol Development Co., Inc., seeking $16,684.80 for breach of contract regarding property improvements, plus costs of the suit.

Macoupin County Housing Authority filed a complaint in forcible entry and detainer July 3 against Sarah Lehman, seeking possession of property in Virden; rent, late fees and/or other monies due and owing; reasonable attorney’s fees; and court costs.

Felonies

Michael D. Fenstermaker, 41, Chesterfield, has been charged with aggravated battery in connection with a June 25 incident in which he allegedly shoved a peace officer to the ground.

Jessica L. Smith, 40, Gillespie, has been charged with unlawful possession of less than five grams of meth in connection with a March 27 incident.

Stephen L. Barrick, 43, Virden, has been charged with theft in connection with a May 11 incident in which he allegedly exerted unauthorized control over an individual’s cash valued at less than $500.

Jeffrey F. Stoops, 48, Staunton, has been charged with unlawful possession of less than five grams of a substance containing meth in connection with a June 30 incident.

Brandon L. Weatherford, 24, Carlinville, has been charged with theft and criminal damage to property in connection with a June 30 incident in which he allegedly exerted unauthorized control over a coin-operated amusement machine motherboard owned by Plaza Laundromat, valued at more than $500, and caused more then $500 damage to bathroom fixtures and a coin-operated amusement machine at the laundromat by breaking the doors to the bathroom and machine.

Andrew D. Kuehn, 38, Gillespie, has been charged with aggravated battery and resisting a peace officer in connection with a July 1 incident in which he allegedly kicked a peace officer and attempted to push another officer and walk away after being told he was being detained.

Devin S. Dahmer, 33, Highland, has been charged with aggravated assault in connection with a July 3 incident in which he allegedly swung a knife at a Macoupin County Sheriff’s Department peace officer.

Milburn J. Lindsey Jr., 36, Carlinville, has been charged with theft in connection with a June 2 incident in which he allegedly exerted unauthorized control over a chain link fence belonging to Carlinville Park Board, valued at less than $500.

Sebastian S. Nessl, 23, Mt. Olive, has been charged with unlawful possession of a controlled substance (a substance containing FUB-AMB) in connection with an April 11 incident.

Anel Berisa, 21, Mt. Olive, has been charged with unlawful possession of less than five grams of a substance containing meth in connection with a May 3 incident.

Tradena L. Peters, 28, Bunker Hill, has been charged with unlawful possession of a controlled substance (a substance containing cocaine) in connection with a May 18 incident.

Misdemeanors

Jessica L. Holliday, 29, Staunton, has been charged with domestic battery and resisting a peace officer in connection with  a June 29 incident in which she allegedly struck an individual in the chest with her hand and refused to comply with an officer’s demands to stand up and place her hands behind her back.

Craig A. Swift, 28, Carlinville, has been charged with violation of an order of protection in connection with a July 1 incident in which he allegedly was within 500 feet of a protected person.

Ryan A. Zarrillo, 24, Girard, has been charged with disorderly conduct in connection with a July 3 incident in which he allegedly threw beer steins and mugs and threatened an individual.

Taylor G. Simburger, 27, Benld, has been charged with criminal damage to property in connection with a June 30 incident in which he allegedly caused less than $500 damage to an individual’s windows.

David W. Hampton, 53, Litchfield, has been charged with battery in connection with a July 8 incident in which he allegedly pushed an individual.

Isiah W. Amos, 20, Quincy, has been charged with domestic battery in connection with a July 7 incident in which he allegedly struck an individual in the face with his fist.

Robert D. Best, 18, Staunton, has been charged with criminal trespass to a motor vehicle in connection with a May 18 incident in which he allegedly operated an individual’s 2008 Chrysler Town and Country van without authority.

Jessica D. McCollum, 43, Mt. Olive, has been charged with theft of services in connection with a May 25 incident in which she allegedly accessed and used Kaho Water District water services after the water meter to her residence was locked in the “off” position by Kaho Water District.

DUIs

Cyle R. Traster, 31, Carlinville, has been charged with two counts of driving under the influence and one count each of failure to signal when required and illegal stopping/parking in the roadway in connection with a June 30 incident in which he allegedly drove a green 2002 Ford at the intersection of Johnson and Washington streets, Carlinville.

Lammar D. Johnson, 38, East St. Louis, has been charged with driving under the influence of drugs in connection with a July 2 incident in which he allegedly drove a green 2003 Kawasaki motorcycle at the intersection of Miles Station Road and Count Road 57, south of Shipman.

Tanner J. Ontis, 20, Fieldon, has been charged with two counts of driving under the influence and one count each of improper lane usage and operating an uninsured motor vehicle in connection with a July 3 incident in which he allegedly drove a white 2002 Ford F150 at the intersection of Maple and Virginia streets in Brighton.
